Justiniano sentenced to prison for possession of child porn

Josue Rivera (AKA Justiniano)

Josue Rivera, better known to comics fans as the artist Justiano, was sentenced this morning in Connecticut to 10 years in prison for possession of child pornography, suspended after he serves three years. That will be followed by 10 years probation.

The Creeper artist pleaded guilty in July to second-degree possession of child pornography following a 2010 incident in which he mistakenly gave a funeral home director a thumb drive containing 33 files classified by police as child pornography instead of the one containing photos of a deceased relative. Police later seized Rivera’s computer and found additional files of suspected child pornography.

Although the 39-year-old artist claimed at one point he had only been looking at the photos because he was bored, the Connecticut Post reports the files included the head of Rivera’s 10-year-old niece Photoshopped onto the nude body of a girl having oral sex.

When asked this morning by the judge whether he had anything to say, the newspaper reports Rivera responded, “I think I’m good.”

He initially pleaded not guilty to first-degree possession of child pornography, and requested a jury trial. But then in June a judge denied a motion to suppress the thumb drive, which Rivera’s attorney argued was obtained by police through an illegal, warrantless search. The judge ruled the search valid, as the material on the drive was brought to the attention of the police by a third party, the funeral home director.

As Justiniano, Rivera had penciled such titles as DC Comics’ The Creeper, Day of Vengeance and Countdown to Mystery, as well as Chaos! Comics’ Chastity: Rocked and Evil Ernie: Straight to Hell.

He can still draw the only question is who’d publish.

I think only the very underground will take his work

The worst part? The fact he had a photo with his niece’s head Photoshopped onto it. That’s fucking crazy. Hope he gets the maximum sentence, tbh.

Agree with Sammo, that part is especially disturbing.

Also, if you had that thumb drive that could land you in prison, wouldn’t you make damn sure you didn’t mistakenly give it to someone?

I wonder how much child pornography is on the computers of the police, lawyers and judges.

Thank god he was stupid enough to get caught. I have no sympathy for pedophiles.

He deserves to serve the full sentence.

He deserves full punishment and so does every scumbag like him. It is not a victimless crime.

Any kid reading this who is being abused, please go to the police so the person hurting you can be brought to justice. When they’re done with you they’ll just turn to someone else. Any adult out there who thinks they might have a problem…please seek help.

congratulations buddy, with that photoshopped picture of your niece, you’ve officially made child pornography even more disturbing

Marc, you`re a moron. Of course the police, judges, and lawyers have this type of information on their computers. It`s called evidence, and they gather it to prosecute and put away filth that prey on children. For you to make such an ignorant comment boggles the mind. All credit to the men and women who have to wade through this type of material to try and keep our kids safe. They are the real heroes. Marc, you need to grow up.

Ya Jimmy, because no police, lawyers and judges break the law.

Looks like I’ll have to get rid of all the comics I own that he drew, I feel dirty owning them!
