We&#8217;ve already seen evidence of that commitment in the use of fill-in artists and some creative assists, but now it looks as if one of its titles is missing a beat &#8212; and it&#8217;s the biggest title the company has.</p>
<p><em>Justice League </em>#5 was scheduled for release Jan. 18, according to the <a href="http://www.comicbookresources.com/?page=article&amp;id=34977" target="_blank"><em>Previews </em>catalog</a> as well as the publisher&#8217;s own <a href="http://dccomics.com/dcu/comics/?cm=20926" target="_blank">website</a>, but recent information from Diamond Comic Distributors suggests it won&#8217;t make that date.</p>
<p>Issue 5<em> </em>isn&#8217;t among the titles the distributor has scheduled to ship <a href="http://www.previewsworld.com/Home/1/1/71/954" target="_blank">Wednesday</a> &#8230; or <a href="http://www.previewsworld.com/Home/1/1/71/977?articleID=117036" target="_blank">the week after</a>. Robot 6 emailed DC comment and a revised release date, but has yet to receive a response.</p>
<p>Although a late title <em>clearly</em> isn&#8217;t unheard of, this one is intriguing for two reasons: first, because it&#8217;s the flagship of DC&#8217;s &#8220;New 52,&#8221; and second, because the creators involved, writer Geoff Johns and artist Jim Lee, are also company executives who, at least indirectly, oversee the line editors whose responsibility it is to make sure books ship on time. It&#8217;s important to note the reason for the lateness can&#8217;t be connected to Johns or Lee; the blame could fall on any step of the production chain.</p>
<p><span id="more-103310"></span></p>
<p>While DC hasn&#8217;t responded to our earlier inquiry, we <em>did</em> find a comment made by Co-Publisher Dan DiDio during the lead-up to New 52 regarding this this potential issue.</p>
<p>&#8220;[Timeliness is] more hard-line than in the past for several reasons, and one is  that it&#8217;s the largest concern we&#8217;ve heard from retailers on a continual  basis,&#8221; he said in <a href="http://www.newsarama.com/comics/dcnu-didio-lee-talk-new-52-110719.html" target="_blank">an interview with Newsarama</a>. &#8220;They&#8217;ve been concerned in the past about our inability to put out  books on a consistent basis, especially the books that people are  looking for.&#8221;</p>
<p>DiDio stressed that DC has a &#8220;contract with the retailers&#8221; and the fans for consistent releases, and admitted that sales have suffered when the publisher released late books in the past.</p>
<p>He specifically guaranteed &#8220;100 percent delivery,&#8221; which this delayed <em>Justice League </em>#5<em> </em>would break from, saying, &#8220;There&#8217;s nothing more frustrating for me or any of the fans, I&#8217;m  sure,  to be excited about something then not be really sure when it&#8217;s  coming  out.&#8221;</p>
<p><strong>Update (11:17 a.m. PT): </strong>A DC spokesperson responded that <em>Justice League </em>#5 is now scheduled for release on Jan. 25, just one week after its original date. The Diamond&#8217;s tentative shipping for Jan. 25 list doesn&#8217;t yet reflect that information.</p>
<p><strong>Update (3: 38 p.m. PT): </strong>A DC representative has since <a href="https://twitter.com/#!/DCComics/status/157948130489417731" target="_blank">tweeted</a>: &#8220;We can confirm that <em>Justice League</em> #5 from @jimlee and @geoffjohns is indeed hitting shelves next week.&#8221;</p>
<p><strong>Update (5:19 p.m. PT): </strong>DC has clarified its previous statement, <a href="https://twitter.com/#!/DCComics/status/157991305874644993" target="_blank">tweeting</a>: &#8220;Sorry for the confusion: <em>Justice League</em> 5 will hit shelves on January 25th.&#8221;</p>

Antarctic CEO Joe Dunn signed the temporary restraining order, signifying that Antarctic agreed to it; the two companies are negotiating a settlement, according to court papers. One interesting tidbit: <em>Diary of a Zombie Kid</em> sold all of 850 copies in comics shops in August, while the first printing on the latest <em>Wimpy Kid</em> book was 6 million. <p>The takeaway from <a href="http://www.comicbookresources.com/?page=article&amp;id=35845" target="_blank">November&#8217;s direct-market sales estimates</a> <em>seemed</em> to be that Marvel had rebounded from its <a href="http://www.comicbookresources.com/?page=article&amp;id=35298" target="_blank">thrashing the previous month by DC Comics</a>, whose New 52 numbers appear to be settling. With 33.3 percent of dollar shares and 37.94 percent of unit sales, the House of Ideas came within two points of its competitor.</p>
<p>However, in its analysis <a href="http://icv2.com/articles/news/21714.html" target="_blank">ICv2.com</a> suggests that those numbers don&#8217;t tell the whole story, and that the sales of some of Marvel&#8217;s top titles are a <em>bit</em> &#8212; or, in one case, &#8220;seriously&#8221; &#8212; inflated.</p>
<p>The retail news and analysis site reminds us that the publisher&#8217;s top-selling comic at No. 5, the $5.99 <em>Point One</em>, was over-shipped, with stores receiving double their initial orders as free copies. That means retailers didn&#8217;t order an estimated 113,352 copies but rather around 56,600, placing <em>Point One</em> at No. 29 on the Diamond Comic Distributors chart, between <em>The Amazing Spider-Man</em> #673 and <em>The Avengers</em> #19.</p>
<p>Skipping past <em>The Avenging Spider-Man</em> #1 and <em>Wolverine and the X-Men</em> #2, with their variant covers &#8212; four for the former alone &#8212; brings us to <em>Fantastic Four</em> #600, the anniversary issue whose $7.99 price tag helped Marvel to gain ground in dollar share.</p>

<p>Image Comics Publisher Eric Stephenson <a href="http://it-sparkles.blogspot.com/2011/11/you-cant-do-that.html">said on his blog yesterday</a> that the cover for <em>Pigs </em>#6 and an image from <em>Glory </em>#23<em> </em> include swastikas and thus will not be featured as originally drawn in Diamond&#8217;s December <em>Previews</em>. The catalog is distributed in Germany, where <a href="http://en.wikipedia.org/wiki/Strafgesetzbuch_%C2%A7_86a">the law</a> prohibits the &#8220;use of symbols of unconstitutional organisations,&#8221; which includes the swastika if used in conjunction with Nazi idealism.</p>
<p>&#8220;This is nothing new,&#8221; Stephenson wrote. &#8220;Swastika-laden images have been prohibited from appearing in publications sold in Germany for decades at this point. I&#8217;m not sure I understand what the point is, though. World War II did happen, and Nazis did exist. I understand not wanting to encourage modern day Neo-Nazi groups, but censorship isn&#8217;t a particularly effective weapon against hate groups of any kind. Plus outlawing specific Nazi iconography seems strangely revisionist, as though it&#8217;s best to just not acknowledge the impact that symbol had, or the evil associated with it.&#8221;</p>
<p>The law Stephenson refers to is a remnant of the &#8220;<a href="http://en.wikipedia.org/wiki/Denazification">Denazification</a>&#8221; efforts in Germany by the Allies after World War II. Among other initiatives, the Allies sought to remove all symbols of Nazism, such as the swastika, from German culture. <a href="http://comiksdebris.blogspot.com/2009/06/boys-and-their-swastikas.html">In a post written in 2009</a>, when a swastika appeared <a href="http://www.bleedingcool.com/2009/06/24/sex-and-violence-is-fine-but-a-swastika-is-too-far/">on a cover for <em>The Boys</em></a>, German writer Marc-Oliver Frisch noted that the law has an exceptions clause, that it “shall not be applicable if the means of propaganda or the act serves to further civil enlightenment, to avert unconstitutional aims, to promote art or science, research or teaching, reporting about current historical events or similar purposes.” While <em>The Boys</em> issue with the swastika was not distributed in Germany, the German version of <em>Maus</em>, however, <a href="http://www.amazon.de/Maus-Art-Spiegelman/dp/3596180945/ref=sr_1_2?ie=UTF8&amp;qid=1320768093&amp;sr=8-2">uses the original cover art</a> that includes the swastika &#8212; but convention posters that used the <em>Maus</em> artwork have also been known to be <a href="http://gocomics.typepad.com/rcharvey/2009/04/maus.html">confiscated by German authorities</a>.</p>
<p>&#8220;Now you could argue that the paragraph clearly says that one of the exceptions is a work of art, which comics clearly are,&#8221; German blogger Subzero wrote <a href="http://talesfromthekryptonian.blogspot.com/2011/07/what-could-possibly-be-my-last-post.html">in a post earlier this year</a>. &#8221; Well, not here in Germany and I guess it&#8217;s going to take a few decades till somebody here is willing to go to court on that point. In Germany comics don&#8217;t have that position.&#8221;</p>
<p>The <em>Glory</em> image that will appear in the catalog will not include the symbol, while the <em>Pigs</em> cover will be blurred out, as seen in the above image. <p>As <a href="http://www.comicbookresources.com/?page=article&amp;id=35298" target="_blank">Comic Book Resources reported on Friday</a>, DC claimed 42.47 percent of the market in dollars and 50.97 percent in united sold in October and dominated Diamond Comic Distributors&#8217; Top 20 with 17 spots. According to newly released estimates from ICv2, the top six DC titles broke the 100,000-copy mark, led by Geoff Johns and Jim Lee&#8217;s <em>Justice League</em> #2 with about 180,700.</p>
<p>Sales of 14 New 52 titles saw gains from their first issues, with <em>Animal Man</em> boasting a 14-percent jump, followed by <em>Batman</em> and <em>Swamp Thing</em> with 7 percent each. <em>Superman</em> and <em>Blackhawks</em>, however, saw 26-percent drops. Perhaps unsurprisingly, the two DC relaunches that attracted controversy, <a href="http://robot6.comicbookresources.com/2011/09/dcs-push-for-the-new-52-this-is-a-catwoman-for-2011/" target="_blank"><em>Catwoman</em> and <em>Red Hood  and the Outlaws</em></a>, saw 6-percent jumps.</p>
<p>Just one Marvel title sold more than 100,000 copies: <em>Incredible Hulk</em> #1, by Jason Aaron and Marc Silvestri, with about 106,470. <em>Wolverine and the X-Men</em> #1 and <em>Fear Itself</em> #7 each hovered above 95,000.</p>
<p>It&#8217;s probably also worth pointing out the sheer number of DC reorders that appear high on <a href="http://www.icv2.com/articles/news/21453.html" target="_blank">October&#8217;s Top 300</a>, led by <em>Aquaman</em> #1 in the 88th spot with more than 28,000 copies (pushing total sales of the first issue past 100,000 copies). That&#8217;s more than the orders for new issues of Marvel&#8217;s <em>Hulk</em>, <em>Deadpool</em>, <em>Punisher</em> and <em>Thunderbolts</em>.</p>

<p>Many retailers already hold kid-focused events on Halloween, with some giving away comics left over from Free Comic Book Day. Diamond has in the past encouraged stores to give away themed kid-friendly minicomics as &#8220;sugar-free safe bag stuffers.&#8221; <a href="http://previewsworld.com/public/default.asp?t=1&amp;m=1&amp;c=6&amp;s=782&amp;ai=113344&amp;ssd=" target="_blank">This year&#8217;s selections</a> include 16-page issues of <em>Scary Godmother</em>, <em>Archie&#8217;s Laugh Comics</em>, <em>Donald Duck</em> and <em>The Smurfs</em>. However, next year&#8217;s offerings will be part of a full-fledged Free Comic Book Day event.</p>

<p>DC carved out a 35.74 percent of the market in dollars and 43.04 percent in units sold, versus Marvel&#8217;s 35.7 percent and 37.88 percent, according to figures released this morning by <a href="http://www.diamondcomics.com/public/default.asp?t=1&amp;m=1&amp;c=3&amp;s=5&amp;ai=113695" target="_blank">Diamond Comic Distributors</a>. The $2.99 cover price for the vast majority of DC&#8217;s line &#8212; the 40-page <em>Action Comics</em>, <em>All-Star Western</em> and <em>Men of War</em> were $3.99 &#8212; prevented the dollar share from being larger.</p>
<p>The publisher claimed 17 of the Top 20 spots, led by Scott Snyder and Greg Capullo&#8217;s <em>Batman</em> #1 at No. 1. It was followed by <em>Action Comics</em> #1, by Grant Morrison and Rags Morales, which, because of its cover price, was actually the top-selling comic in terms of dollars.</p>
<p>Marvel entered the list at No. 8 with <em>Fear Itself</em> #6, followed by <em>Ultimate Comics Spider-Man</em> #1 at No. 9, and <em>The Amazing Spider-Man</em> #699 at No. 18.</p>
<p>While many will undoubtedly see this as further evidence that DC&#8217;s relaunch gamble has paid off, <a href="http://www.warrenellis.com/?p=13409" target="_blank">Warren Ellis was quick to throw cold water on those market-share numbers</a>, writing, &#8220;So DC Comic’s media-blitzed massive relaunch of its entire line in September got them this: A half-point lead in dollar share over Marvel Comics (who had <em>one</em> high-profile launch in the September frame). A five-point lead in units sold over Marvel Comics. But all those units DC sold are returnable.</p>
<p>&#8220;Thank god all those DC execs told everyone they weren’t interested in  market share. Otherwise someone might have come away with the notion  that DC really intended to give Marvel a fight in the marketplace and  make Marvel sort their own shit out. What a stroke of luck for  everybody.&#8221;</p>

Calls for confirmation this morning to Haven&#8217;s Skokie, Illinois, offices went to voicemail. The company&#8217;s closing would leave Diamond without any significant competition for independent comics distribution &#8212; <em>print</em> comics, at least. As Johanna notes, the industry giant still has a rival in another quarter: digital distributor comiXology. <p><strong>Legal</strong> | The defense rested in the Michael George trial Tuesday after the comics retailer, who is accused in the 1990 murder of his first wife, chose not to take the stand. His lawyers argued that if he were to do so, his testimony would become the sole focus of the trial. George&#8217;s current wife Renee, who was kept out of the courtroom for most of the trial in case she was called as a witness, also did not testify. Closing arguments are scheduled for Thursday, and then the case will be sent to the jury. That, of course, means another cover: a modified version of <a href="http://robot6.comicbookresources.com/2011/08/when-male-justice-leaguers-strike-a-wonder-woman-pose/" target="_blank">the lampooned variant created by David Finch</a> (see below). There&#8217;s now an apocalyptic-looking red background &#8212; somewhat fitting, considering Superman&#8217;s foreboding &#8220;Obey!&#8221; pose &#8212; and, more importantly, <em>Cyborg</em>. That&#8217;s right, Victor Stone, absent from Finch&#8217;s original cover, has been squeezed into the Justice League lineup, behind The Flash.</p>
<p>Along with the <em>Justice League</em> announcement, DC <a href="http://dcu.blog.dccomics.com/2011/09/19/justice-league-1-and-another-full-week-of-dc-comics-the-new-52-comic-books-are-going-back-to-press/" target="_blank">revealed</a> that all 12 titles debuting Wednesday have already sold out on the distributor level, and are also going back to press. Even <em>Red Hood and the Outlaws</em>.</p>

That noise you just heard was the sound of speculators making a frantic dash to their local comics store.</p>
<p>The flaw in question is a little green teardrop above Sinestro&#8217;s ear (you can see it in the image on the right). DC asks retailers to report the flawed copies to Diamond Comic Distributors by Monday. Replacement copies will arrive on Oct. 12, the same day as <em>Green Lantern</em> #2.</p>
<p>Naturally, <a href="http://www.ebay.com/itm/Green-Lantern-1-DC-NEW-52-LAUNCH-TEARDROP-MISPRINT-VARIANT-ULTRA-RARE-/250892935701?pt=US_Comic_Books&amp;hash=item3a6a626215" target="_blank">a flawed copy has already made its way onto eBay</a>, where the starting bid is $9.99. However, what DC labels &#8220;a printing error,&#8221; the seller characterizes as a sly maneuver by the publisher: &#8220;I&#8217;VE PLACED THE TEARDROP  MISPRINT COVER IN ONE PHOTO AND REGULAR COVER ON THE OTHER PHOTO. ITS REALLY OBVIOUS. I&#8217;LL LET YOU BE THE JUDGE, CALL IT WHATEVER YOU LIKE. I think it was intentional especially with a launch of this magnitude.&#8221;</p>
<p>What DC would get out of it, I don&#8217;t know. But far be it for me to question a shrewd owner of an &#8220;unread, NM, dripping wet off the presses&#8221; copy of the &#8220;Teardrop Misprint Variant.&#8221;</p>

<p>DC Comics has received reports of a printing error on the front cover of some copies of GREEN LANTERN #1 (JUL110218). The flaw is an irregular green loop that appears above Sinestro’s ear.</p>
<p>Please check all of your copies for the flaw and report any flawed copies as damages to Diamond by Monday, September 19. DC is working to pull copies printed for other markets to replace the damaged copies, but we need to know the size of the problem and we need to audit our existing inventories to avoid sending out additional flawed copies.</p>
<p>Replacement copies will be scheduled to arrive in stores October 12, the same day issue #2 is scheduled to arrive in stores.</p></blockquote>
