Passings | Acclaimed sci-fi novelist and manga writer Kazumasa Hirai passed away Jan. 17 at age 76. Hirai was the co-creator of several manga that spawned anime, prose and television franchises, including Genma Taisen and the classic cyborg superhero story 8 Man. He also collaborated with Ryoichi Ikegami on the Spider-Man manga, serialized from 1970 to 1971 in Monthly Shonen Jump, succeeding Kōsei Ono as writer. [Anime News Network]
Legal | The Bombay High Court heard arguments Monday on a public interest litigation petition challenging India’s sedition act. The petition stems from the 2012 arrest of cartoonist Aseem Trivedi on sedition charges, which were dropped after national and international protests. “It [sedition charge] can be misused any time,” said Chief Justice Mohit Shah. But Advocate-General Sunil Manohar, arguing for the state, said they only acted on the Trivedi case after receiving a dozen complaints: “The cartoonist [Aseem Trivedi] ran perilously close to borderline. He is not absolutely innocent. It is not the case that the state vindictively slapped charges on him.” The court did not immediately hand down a decision but has reserved judgment. [The Hindu]
Legal | Attorney Tom Goldstein, co-founder of the respected SCOTUSblog, has joined with Marc Toberoff to represent the heirs of Jack Kirby in their appeal to the U.S. Supreme Court of the Second Circuit’s affirmation that the artist’s contributions to Marvel between 1958 and 1963 were work for hire and therefore not subject to copyright termination. In a response filed this week to Marvel’s brief urging the high court to decline review, Goldstein and Toberoff again challenge the Second Circuit’s “instance and expense” test and its definition of “employer,” and argue, “Many of our most celebrated literary and musical works were created before 1978 and signed away to publishers in un-remunerative transactions. Termination rights were ‘needed because of the unequal bargaining position of authors.’ It would be hard to find a better example of this than the prolific Jack Kirby, who worked in his basement with no contract, no financial security and no employment benefits, but without whom Marvel might not even be in business today.” [Hollyqood, Esq.]

Retailing | The manager of Dragon’s Lair Comics & Games in Omaha, Nebraska, estimates 50 to 60 percent of their inventory was ruined by smoke and water after a fire broke out Sunday in the building that’s housed the store’s main location since 1976. Employees have been sorting through tens of thousands of comics to determine what can be salvaged while directing customers to the Dragon’s Lair store in the city’s Millard neighborhood. The hope is to use a store room next to the damaged building to begin offering limited services to customers — pull lists and special orders — as the retailer plans for what comes next. “We have every intention of reopening, here or elsewhere,” manager Craig Patterson said. “More than likely it will be elsewhere. And hopefully bigger and better than before.” [World-Herald]
Nancy Goldstein’s Jackie Ormes: The First African American Woman Cartoonist suffers a bit from a lack of access to information.
While the author’s sources include Ormes’ sister and a cartoonist colleague, and her subject was, as she put it, “a saver,” she also notes early on that she didn’t have letters to or from Ormes, a traditional source for what’s going on in a biography subject’s head, nor, apparently, did she have any sort of journal or diary.
The resultant book then is, perhaps, imperfect. Goldstein makes quite clear what an incredible, colorful person Ormes was, and what a fascinating life she lead, but the biographical sections are tantalizing: One may find oneself wanting much more detail, to join Ormes in the newspaper offices or society functions she covered and put on.
And while there is an awful lot of comics art reproduced within its pages, but due to the special and financial limitations of this book (it’s not an archival project, after all) and the simple lack of availability of original art, original newspapers her work was published in, or even copies or microfilm of those papers, much (too much) of Ormes’ work is lost to history.
